COACHING TERMS AND CONDITIONS

These Terms and Conditions govern the business relationship between immer Resilience (referred to as “Provider”) and its client (referred to as “Client”) concerning the provision of coaching services.

1.  Object of Contract:

The Provider will provide “Coaching Services” in the areas of professional coaching and resilience building with the goal of preventing burn-out, managing stress, developing career and strengthening self-efficacy. The precise description of the Coaching Services is agreed upon individually with the Client.

2. Fees and Payment Terms:

The amount of fees for Coaching Services is determined in a separate agreement between the Provider and the Client. Payments are due at the conclusion of each session.
Payment shall be made via Bank Transfer, Stripe, TWINT, Wise Transfer or PayPal.

3. Appointment Scheduling and Cancellations:

The Provider and the Client will schedule session appointments at a time and date as mutually agreed. The Client may cancel or reschedule appointments at no charge 48 hours or more before the scheduled appointment. For cancellations with less than 48 hours’ notice or session “no shows”, the full fee for the session will be charged via the agreed upon payment method.

4. Confidentiality:

The Provider shall treat sensitive information disclosed during Coaching Services as confidential. This obligation continues for the lifetime of the Provider after the termination of the business relationship.

5. Disclaimer of Liability:

The Coaching Services provided by the Provider are for Client’s personal and professional development. They do not substitute for medical, legal, or professional advice. The Client agrees and accepts all liability resulting from making decisions or taking actions or inactions as a result of Coaching Services. Client acts solely at its own risk and holds Provider harmless from all liability, damages, claims, or causes of action brought by Client or by anyone on Client’s behalf as a result of, or in any way connected with Client’s participating in Coaching Services.

6. Data Protection:

The Provider commits to complying with data protection regulations according to applicable laws. The company’s privacy policy is available at www.immerresilience.com.

7. Termination:

Either party can terminate the Coaching Services by written notice. Prepaid fees for unused coaching services will be refunded on a pro-rata basis.

8. Changes to the Terms and Conditions:

The Provider reserves the right to modify these Terms and Conditions at any time and will be effective as of the date updated. Updated Terms and Conditions will be published on the Provider’s website.

9. Applicable Law and Jurisdiction: For the resolution of disputes arising from this contract, the ordinary courts of the Canton of Zurich are recognized as competent. The exclusive place of jurisdiction is the registered office of Immer Resilience. Swiss Laws shall apply to this contract.

10. Miscellaneous:

Any changes or additions to these Terms and Conditions require the written consent of both parties.

RETREAT TERMS AND CONDITIONS

These Terms and Conditions (“Agreement”) govern the relationship between immer Resilience, hereinafter referred to as the “Provider,” and the participant, hereinafter referred to as the “Participant,” for the a Dolphin Retreat under the advertised name (the “Retreat”) organized by the Provider, and are effective upon date of registration. By registering and participating in the Retreat, the Participant agrees to adhere to the following terms and conditions:

1. Registration and Payment:

1.1. The Participant shall complete the registration process and make the required payment to secure a spot in the Retreat. This registration process will take place through completing a form that Participant will receive access to upon request. This request can be initiated through email, text message, or phone call.

1.2. Fee Structure and Payment Terms are as follows:

a) Deposit to secure your Spot:         500 CHF
b) 90 days Prior to Retreat:               50% of the Retreat Price
c) 45 day Prior to Retreat:                 Remaining Balance

Payment shall be made via Bank Transfer, Wise Transfer, Stripe, TWINT or PayPal.

2. Cancellation and Refund Policy:

2.1. Cancellation by Participant:
a) Cancellation requests made 90 days prior to the Retreat are subject to the non-refundable deposit fee of 500 CHF. This deposit is not eligible for refund as it covers the administrative fees of the Provider.

b) Cancellation requests made within 90 days of the Retreat start date, up to 50% of the Retreat price will be refunded.

c) Cancellation request made within 30 days of the Retreat start date are not eligible for refund, and the Participant must pay 100% of the Retreat price.

d) The Cancellation Policy applies for all reasons (illness, accident, work commitments) and therefore the Provider recommends purchasing Travel Insurance separately.

2.2. Cancellation by Provider:
a) The Provider reserves the right to cancel the Retreat due to unforeseen circumstances or insufficient number of participants at any time. In such cases, Participant will receive a full refund of their Retreat price.

b) The Provider reserves the right to reschedule the Retreat due to unforeseen circumstances at any time. In such cases, Participant will have the option to participate on the new trip dates or request a full refund of their Retreat price.

The Provider is not responsible for any additional costs incurred by the Participant, such as travel or accommodation expenses, in the event of a Retreat cancellation.

3. Retreat Participation:

3.1. The Participant has the choice of not registering and therefore not participating in any or all scheduled Retreat activities, workshops, and sessions. If the Participant chooses not to register/participate in a scheduled event, the Participant shall, on a non- interference basis, engage in individual pursuits.

3.2. Notwithstanding the foregoing, the Participant agrees to fully engage in all activities that were individually booked at the time of registration.

3.3. The Participant shall respect the guidelines set forth by the Provider, including rules of behavior, group dynamics, and respectful communication.

3.4. Any disruptive or disrespectful behavior may result in the Participant’s immediate dismissal from the Retreat without refund.

3.5. Any complaints or grievances must be reported to the Provider immediately on-site to pursue any potential actions. No claims for remuneration can be made for any complaints or grievances.

3.6. The Provider shall work with the boat crew to provide the best dolphin encounter possible, however the Provider does not guarantee any dolphin encounters as these are wild, free-roaming animals.

4. Health and Safety:

4.1. The Participant is responsible for ensuring he/she is physically and mentally fit to participate in the Retreat’s activities, and is responsible for his/her own insurance and medical care before, during and after the trip.

4.2. The Participant shall inform the Provider of any medical conditions, allergies, or dietary restrictions that may affect his/her participation in the Retreat.

4.3. Participation in the Retreat is at Participants own risk and attests that he/she is physically capable of performing the activity and assuming full responsibility for personal injury and further release Provider (Immer Resilience) for injury, loss or damage arising out of Participant’s participation. The Provider shall not be held liable for any injuries, illnesses, losses or accidents that may occur during the Retreat. Specifically the Participant is responsible for their own Accident Insurance and Liability Insurance.

4.4 Participant agrees to observe and obey all posted rules and warnings, including any oral instructions or directions of Provider (Immer Resilience) or its representatives or agents, including the wearing of protective gear thus prescribed.

4.5. The Participant shall follow the instructions of the boat crew and follow all instructions of the dive and snorkel instructors. An additional liability release form issued by the Owner/Operator of the Vessel shall be signed by each Diver and/or Snorkler in order to be able to participate.

5. Travel, Meals and Accommodation:

5.1. The Participant is responsible for arranging and covering the costs of his/her travel and accommodation to and from the Retreat location, as well as covering any costs not covered in the retreat fee such as Travel Visa Costs.

5.2. The Participant is responsible for ensuring their travel documents and Visa’s are valid and current for the Retreat.

5.3. The Retreat Fee covers meals, snacks and non-alcoholic beverages while aboard the Vessel.

6. Intellectual Property:

6.1. All materials, content, and resources provided during the Retreat, including but not limited to presentations, handouts, and recordings, are the intellectual property of the Provider.

6.2. The Participant agrees not to reproduce, distribute, or share any of these materials without the prior written consent of the Provider.

6.3. The Trademark of ResilienceBuilder ® is protected. Unauthorized use, reproduction, or dissemination of these materials is strictly prohibited without explicit written permission by the Owner of ResilienceBuilder ®. 7. Photography and Media:

7.1. The Provider may take photographs, videos, or recordings during the Retreat for promotional, archival, and documentation purposes.

7.2. The Participant consents to the use of their likeness in such materials without compensation. Should a Participant explicitly not want to be included in any Photographs, the Participant must inform the Provider on the first day of the retreat.

 8. Modifications and Amendments:

8.1. The Provider reserves the right to make changes to the Retreat schedule, activities, and content as deemed necessary.

8.2. Any substantial changes will be communicated to the Participant in a timely manner.

 9. Privacy Policy:

9.1. The Provider will collect and store personal information as necessary for Retreat administration and communication.

 9.2. The Provider will not share or sell this information to third parties.

10. Governing Law:

10.1. For the resolution of disputes arising from this contract, the ordinary courts of the Canton of Zurich are recognized as competent. The exclusive place of jurisdiction is the registered office of Immer Resilience. Swiss Laws shall apply to this contract.

10.2. If any provision of these Terms and Conditions becomes invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. In place of the invalid provision, a legally permissible provision that most closely corresponds to the economic purpose of the invalid provision shall apply.

By participating in the Retreat, the Participant acknowledges and agrees to abide by these Terms and Conditions. This Agreement constitutes the entire understanding between the parties and supersedes any prior agreements or understandings, whether oral or written.

By participating in the Retreat, the Participant agrees to indemnify and defend Immer Resilience against all claims, causes of action, damages, judgements, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from participation in the Retreat.

Lomi Lomi

Lomi Lomi Massage is a traditional massage form from Hawaii, which is part of an ancient healing ritual. It is celebrated by the indigenous people during phases of stagnation, illness, and as preparation for significant transitional periods in life (such as puberty, pregnancy, postpartum, before important decisions or new life tasks).

During the Lomi Lomi massage, long, flowing massage strokes performed with the forearms alternate with gentle joint mobilization and deep body and fascia work. Like the waves of the ocean, these connecting movements powerfully and gently harmonize the entire energy system.

Lomi Lomi is guided by selfless presence, non-judgmental acceptance, and loving dedication of the masseur, as well as the recipient’s willingness to be fully present and receptive.

The Healing Power of Lomi Lomi Massage
